1. Introduction
These Terms & Conditions govern the agreement between Fortune Design (“we”, “us”, “our”) and the Client (“you”, “your”) for website design, development, and digital branding services.
By accepting a quotation, making a payment, or signing off on a project, you agree to the following terms.
2. Payment Terms
- We use a 50/50 payment structure:
- 50% deposit is required before work begins.
- 50% balance is due upon project completion and your approval.
- Final files, website access, or launch will only be provided after the final payment is received.
- Payment methods accepted: Online Payment and EFT (Electronic Funds Transfer).
- All deposits are non-refundable once the project has started.
3. Project Scope & Timeline
- The typical project timeline is 2 to 4 weeks, depending on the size and complexity of the project.
- The project includes only the deliverables listed in your approved quotation or proposal.
- Any additional requests or major changes beyond the original scope (e.g., extra pages, new features, or additional revisions) will be quoted and billed separately.
- All additional work must be confirmed in writing before proceeding.
- Timelines are dependent on prompt client feedback, approvals, and content delivery. Delays caused by late responses or missing information may extend the delivery date.
4. Revisions and Approval
- Each project includes a set number of design revisions as stated in your quotation or package.
- Additional revisions beyond the included number may incur extra costs.
- Once final approval is given, any further changes are treated as a new request.
5. Completion and Handover
The project is considered complete when:
- The final design is approved by you.
- The website or deliverables are ready for launch or handover.
- All agreed revisions have been completed.
After final payment:
- You will receive all agreed deliverables, login credentials, and files.
- Fortune Design is not responsible for any issues caused by third-party modifications or hosting providers after handover.
6. Client Responsibilities
- You agree to provide all necessary content (text, images, product info, etc.) promptly.
- You confirm that all content you provide is either owned by you or properly licensed.
- You are responsible for reviewing and approving all work before launch.
7. Intellectual Property
- All project materials remain the property of Fortune Design until full payment is received.
- Upon final payment, ownership of the completed website, designs, and files is transferred to you.
- We reserve the right to display the completed project in our portfolio, social media, and marketing materials.
8. Hosting, Maintenance & Support
- Unless specifically included in your package, hosting and ongoing maintenance are not included.
- Maintenance packages can be added to cover updates, security, and support.
- Without a maintenance plan, post-launch support will be billed per hour or per issue.
9. Cancellation & Refund Policy
- If you cancel before work begins, you may request a refund within 3 days of payment (minus administrative fees).
- Once the project has started, the deposit is non-refundable.
- If the project is cancelled after completion, the full payment remains due.
- Refund requests must be made by email to info@fortunedesign.co.za within the 3-day window.
10. Non-Payment
- If the final 50% payment is not made within 7 days of completion, Fortune Design reserves the right to:
- Suspend or remove the website from hosting.
- Withhold login credentials and design files.
- Apply late fees or collection costs if necessary.
11. Limitation of Liability
- Fortune Design is not liable for any indirect, incidental, or consequential damages arising from use or inability to use the website or designs.
- While we take every precaution to ensure quality and performance, we cannot guarantee that all third-party integrations (e.g., plugins, APIs, or hosting services) will function indefinitely.
12. Confidentiality
Both parties agree to keep all confidential information, credentials, and project details private and secure.
13. Governing Law
This agreement is governed by the laws of South Africa, and any disputes shall be resolved under South African jurisdiction.
14. Acceptance of Terms
By submitting the project request form, approving a quotation, or paying a deposit, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
